THE CONSTRUCTION OF WHAT IS MINE AND YOURS: ANALYSIS OF THE  RECOGNITION OF REAL RIGHTS BY SMALL CHILDREN.

The project aims to extend and deepen the developments reached in the previous stage of this research. The objectives are still set in the broader context of a program intended to advance in the comprehension of social and cognitive development in the child (started in 1986 and directed by Prof. Juan Samaja). In this presentation, the objectives are to resume and expand the developments reached in the previous stage, which was meant to identify the competentes of children from 3 to 6 years of age to borrow, lend and exchange objects. It is proposed to continue with the objective of identifying typical formats regarding the following variables: Â recognized ownership relation, stipulated legal recognition/obligation, material and legal characteristics of the object and regulatory interventions of adults (conceived as functions that guide and orient practical-legal competences). The second objective of the project is to examine possessionary competences regarding the recognition of what is oneâ??s own and what is of another, as they vary according to the type of legal relation with the object (occupancy, tenancy, posession or ownership) and according to the characteristics of the object (whether it is a personal belonging, or it belongs to the childâ??s family, to his/her school, or to society at large). The empirical strategy will combine observation in natural contexts (school environment) and Piagetian style clinical questioning. Observation will be used to achieve the first objective, recovering to that end the empirical advances made in previous stages of this project. The clinical questioning will be used to achieve the second objective. The construction of the instrument for the clinical questioning will be a part of the activities of this research.
