Fiscales y defensores como fuente adicional de distorsión del testimonio

RESUMEN

Se realizaron dos experimentos para estudiar dos fuentes de distorsión del testimonio judicial. El primer experimento replicó hallazgos previos, el segundo aportó evidencia novedosa. Se empleó en ambos un paradigma experimental clásico que utiliza material audiovisual sobre accidentes viales para evaluar el testimonio de los testigos. En el primer experimento se encontró que la manera de preguntar por parte de quien interroga afecta el testimonio. La modificación de los verbos de la pregunta generó distorsiones en la respuesta del testigo. En el segundo experimento se encontró que el rol judicial de quien pregunta también produce distorsiones. Los fiscales obtuvieron testimonios diferentes que los defensores, usando las mismas preguntas. Esto sugiere que es el rol judicial en sí mismo una fuente adicional de distorsión del testimonio. Se discuten estos hallazgos en el contexto de la teoría matemática de la comunicación.

ABSTRACT

Prosecutors and defenders as an additional source of testimony distortion

Two experiments were conducted to study two sources of distortion of judicial testimony. The first experiment replicated previous findings, the second provided novel evidence. In both, a classic experimental paradigm was applied to evaluate the testimony of road accident eyewitnesses using audiovisual materials. In the first experiment, it was found that the way the questioner asks questions affects the testimony. Modifying the verbs in the question generated distortions in the witness´s response. In the second experiment, it was found that the judicial role of the questioner also generates distortions. Prosecutors obtained different testimonies than defenders, using the same questions. This result suggests that the judicial role itself is an additional source of testimony distortion. These findings are discussed in the context of the mathematical theory of communication.
