P001. La Práctica del Psicólogo Forense con Menores Judicializados por Violencia Familiar en el Marco de la Ley 24.417. Determinantes Institucionales.

Lugar de Trabajo: Instituto de Investigación – Facultad de Psicología - UBA La práctica de la psicología jurídica es el producto de una serie de atravesamientos institucionales, entre los cuales la institución del Estado –definido por Foucault como el efecto móvil de una multiplicidad de mecanismos disciplinarios y de control, condición de la gubernamentalidad- constituye un componente fundacional, insoslayable. La ley 24.417 sobre protección contra la violencia familiar –sancionada en 1994- y su decreto reglamentario instituyen la práctica específica objeto de esta investigación. Considerando el nivel de complejidad discursiva y práctica de la psicología jurídica, así como la dinámica institucional en la que se despliega, la modalidad de investigación propuesta es de índole cuali-cuantitativa, e incluye el análisis de las multiples implicaciones institucionales en juego, tanto aquellas que determinan la tarea del investigador, como las que atraviesan la práctica del psicólogo forense. Este campo metodológico tripartito posibilita la exploración de las diversas dimensiones que producen el objeto de estudio. Dada la heterogeneidad y diversidad de la temática, se propone un enfoque interdisciplinario para su abordaje y análisis. En función de lo cual se implementará la metáfora social de la Tolva como dispositivo conceptual y metodológico para el abordaje de la práctica de la psicología jurídica y sus determinantes institucionales.

The law 24.417 –established in 1994- that gives protection against violence in the family , allows the specific practice which is going to be study in this research. Considering the level of discourse complexity and practice of the legal psychology as well as institutional dynamics in which it is displayed, the suggested method of research is quantitative and qualitative and it includes the analysis of various institutional implicatures, not only those that determine the researcher’s role but also those that have to do with the practice of the forensic psychologist. This methodological triangle enables the exploration of different dimensions that produce the object of study. According to the heterogeneity and the thematic diversity, a cross curricular method is suggested. The social metaphor of La Tolva will be implemented as a conceptual and methodological mechanism to tackle the practice of legal psychology and its institutional determiners.
