LA DECISIÓN DEL JUEZ Y LA INTERPRETACIÓN PSICOANALÍTICA

RESUMEN
El presente trabajo transita las coincidencias y divergencias entre el campo discursivo del Derecho y el del Psicoanálisis, en la medida en que el concepto de Ley es central en ambos. Se interna en la práctica singular de estos discursos y trata de situar la relación que pudiera existir entre la decisión del juez al administrar justicia y el acto del analista en el momento de interpretar. Nuestra hipótesis consiste en que ambas acciones constituyen una decisión, entendida ésta como un acto que trasciende el cuerpo teórico del que surge y que debe ser apreciado por sus consecuencias éticas. Estas consecuencias afectan, no sólo al sujeto sobre el que recaen sino al discurso mismo en el que se inscriben. Nuestro desarrollo apuntará a caracterizar dichas acciones, a definir qué entendemos por decisión y a circunscribir sus consecuencias éticas.

ABSTRACT
THE DECISION OF THE JUDGE AND THE ACT OF THE PSYCHOANALYST

We consider the coincidences and divergences between the juridical discourse and the one of the psychoanalysis, taking into account that the concept of law is central in both. Regarding the singularities into the practices of these speeches we try to locate the relation that could exist between the decision of the judge when administering justice and the act of the psychoanalyst at the moment of interpretation. Our central hypothesis asserts that both actions constitute a decision, which is an act that extends the theoretical body from which it arises and that must be appreciated by its ethical consequences. These consequences affect not only the subject to whom they are applied, but also the discourse that sustain them. This paper aims to characterize these actions, to define what we understand by decision and to circumscribe its ethical consequences
