Para el desarrollo de este análisis se toma como punto de partida el proceso de reformulación en el contexto internacional que se inicia con la concepción del niño como sujeto activo de derecho, recogida primeramente por instrumentos internacionales y luego asimilada al ordenamiento jurídico argentino.

Se analizan las posturas doctrinales que dieron origen al debate instaurado entre el principio de autonomía progresiva reconocido por la Convención sobre los Derechos del Niño y el régimen de capacidad de las personas menores de edad regulado en el Código Civil Argentino. Se expone específicamente el tema de la defensa técnica a través de la función del Abogado del Niño.

Por último, se intenta reflexionar sobre su aplicación en las prácticas judiciales, en virtud de las contradicciones observadas entre las instituciones subsistentes propias del régimen anterior y las creadas a la luz del nuevo paradigma de protección integral de los derechos del niño.

This article focuses on the analysis of rethinking (in the international context) the concept of the child as an active subject of law collection; first by international instruments and, then, its implications for the assimilation to the Argentinean legal system.

The doctrinal positions are analyzed by giving rise to debates between the autonomy progressive principle recognized by the Convention on the Rights of Children and the regime of capacity of the people younger than age regulated in the Argentinean Civil Code. Set out specifically the issue of technical defence through the role of Lawyer of the Child.

Finally, I try reflect on its application in the judicial practices, under the contradictions between the institutions remaining own from the previous regime and the created in the light of the new paradigm of comprehensive protection of children’s rights.
