Rol y función en la intervención psicológica. Algunas consideraciones éticas sobre su articulación en la declaración testimonial de niños, niñas y adolescentes en casos de abuso sexual

RESUMEN

Uno de los roles que la Justicia reserva al profesional de la salud mental es el dedicado a obtener la declaración testimonial o el relato de los hechos en casos de abuso sexual contra niños, niñas y adolescentes, que dan origen a un proceso penal. Se realiza un análisis a partir de las disposiciones jurídicas e institucionales que configuran ese rol, que combinan requerimientos del proceso judicial y estrategias para la protección del niño/a, lo cual supone el encuentro de categorías diversas, referidas tanto al sujeto del Derecho como al sujeto del padecimiento psíquico. Esto abre una interrogación ética respecto de nuestra intervención en procedimientos judiciales, una interpelación sobre nuestra posición frente a la articulación entre el rol y la función.

ABSTRACT

Role and function in psychological intervention. Some ethical considerations about their articulation in the testimonial statement of children and adolescents in cases of sexual abuse

One of the roles that the Justice assigns for mental health professionals is the one dedicated to obtaining the testimonial statement or the account of the facts in cases of sexual abuse against children and adolescents, which give rise to a criminal process. An analysis is made based on the legal and institutional provisions that make up this role, which combine requirements of the judicial process and strategies for the protection of the child, whence there is a meeting of different categories, referring to both the subject of law and the subject of psychic suffering. This raises an ethical question regarding our intervention in judicial procedures, an interpellation on our position and the articulation between our role and our function.
