Resumen:

Con el fin de ofrecer un aprestamiento de herramientas metodológicas para la investigación hermenéutica e interpretativa, el siguiente diseño de investigación se enmarca en el proyecto ?Hermenéutica y metodología: desarrollo y evaluación de estrategias metodológicas para la investigación interpretativa? a cargo de la Prof. Dra. Roxana Ynoub.Recuperando las perspectivas de los proyectos precedentes, la presente investigación tiene como propósito aplicar metodologías provenientes del análisis narrativo para una hermenéutica-jurídica de un conjunto de narraciones infantiles. Siguiendo esto, la «experiencia jurídica» será tematizada a la luz de la teoría egológica del derecho formulada por Carlos Cossio (1964) quién define que el objeto del derecho es la ?conducta que se integra con la vivencia de la norma?. Esta formulación revolucionaria al interior de las ciencias jurídicas, postula que no son las normas como código inerte el asunto del jurista, sino la conducta humana que con ellas se integra y se significa. Desde ese marco general, postularemos aquí que las narrativas infantiles contemplan y contienen también esta función ?juridiforme?. En tanto ellas contribuyen a instituir y consagrar formas típicas de resolución de conflictos (o al menos formas socialmente valiosas), como así también a estipular sanciones o consecuencias.

CONTRIBUTIONS OF NARRATIVE ANALYSIS FOR THE DESCRIPTION OF CHILD LEGAL EXPERIENCE.

In order to be able to offer a preparation process of methodological tools for hermeneutics and interpretative investigations, the following investigation design is framed in the project "hermeneutics and methodology: development and examination of methodological strategies for an interpretative investigation" by professor Roxana Ynoub.Following former project perspectives, the purpose of this investigation is to apply methodologies that come from narrative analysis for a hermeneutics-legal of a group of child tales.Accordingly, the "legal experience" will be defined by the egological theory of law that has been formulated by Carlos Cossio (1964), who defines the object of law as the "behaviour that is integrated with the experience of the regulation". This formulation would stir up the deep of legal ciences, and affirms that norms are not defined by the stiffness provided by lawyers, but by human behaviour; this is integrated and signified by the latter.From this general theoretical framework, it will be proposed in this work that child narratives includes, too, this legal function. Not only do they contribute to establish typical forms of conflict resolutions (socially-valued related), but also to stipulate consecuences.
