La Interfase Psico-socio-jurídica y el Derecho de Familia en los Códigos Civiles Argentinos de 1869 y 2014.

RESUMEN

El propósito de este estudio es analizar la relación entre la interfase psico-socio-jurídica propuesta por Silvia Crescini en el contexto de la Psicología Jurídica y la creciente fundamentación del Derecho de Familia en los Derechos Humanos. Se emplea para ello una metodología pluralista que incluye un estudio lingüístico cuantitativo de los Códigos Civiles argentinos sancionados en 1869 y 2014 y una reflexión cualitativa sobre su articulación con la mencionada interfase. Los resultados sugieren que: 1) el desplazamiento hacia los Derechos Humanos se observa en el uso del lenguaje que se emplea en el Código Civil y Comercial de la Nación Argentina en vigencia. 2) La mencionada interfase es compatible con tal desplazamiento. 3) El avance hacia la nivelación de la legislación argentina con los Derechos Humanos es todavía parcial o incompleta. Se discuten los alcances de estos hallazgos y se proponen lineamientos para futuros estudios.

ABSTRACT

The Psychological-social-legal Interface and the Family Law in the Argentine Civil Codes of 1869 and 2014.

The aim of this study is to analyze the relationship between the psychological-social-legal interface introduced by Silvia Crescini in the context of the Legal Psychology and the growing foundation of the Family Law in the Human Rights. A pluralist methodology is applied. It includes a quantitative linguistic study focused on the Argentine Civil Codes sequentially approved in 1869 and 2014, and a set of qualitative insights concerned with the aforementioned interface. The results suggest that: 1) The shift towards the Human Rights can be detected in the use of the language in the argentine Civil Code. 2) The aforementioned interface is consistent with such shift. 3) The integration of the Argentine Law with the international perspective of the Human Rights is still partial and incomplete. Finally, these results are discussed and further research lines are suggested.
