RESUMEN

Este artículo presenta la fundamentación teórico-práctica de una investigación doctoral en curso, que se titula “Derechos y subjetividad: contribuciones del psicoanálisis en prácticas jurídico-proteccionales con niñas, niños y adolescentes” y forma parte de una investigación UBACyT. Se toma como eje central la articulación de derechos y subjetividad en prácticas con niñas, niños y adolescentes del sistema proteccional y jurídico, a partir de una lectura desde el psicoanálisis. Se analiza cómo las normativas internacionales y locales promueven una protección basada en los derechos, pero que a veces omite la dimensión subjetiva y singular de niños y adolescentes. Se enfatiza que una protección cabal de este grupo etario requiere considerar aspectos psicológicos, afectivos e inconscientes. La metodología incluye revisión bibliográfica y entrevistas a profesionales, con el fin de elaborar instrumentos conceptuales que promuevan intervenciones que atiendan a una dimensión del sujeto que no queda garantizada por la protección del sujeto del derecho.

Rights and subjectivity: contributions of psychoanalysis to legal and protectional practices with children and adolescents. Theoretical basis of an ongoing research

This article presents the theoretical and practical foundation of an ongoing doctoral research project entitled “Rights and Subjectivity: Contributions of Psychoanalysis to Legal and Protective Practices with Children and Adolescents,” which is part of a UBACyT research project. Its central focus is the articulation of rights and subjectivity in practices with children and adolescents within the protection and legal system, based on a psychoanalytic perspective. It analyzes how international and local regulations promote rightsbased protection, but sometimes omit the subjective and individual dimension. It emphasizes that comprehensive protection of this group requires considering psychological, affective, and unconscious aspects. The methodology includes a literature review and interviews with professionals, aiming to develop conceptual tools that promote interventions that address a dimension of the subject that is not guaranteed by the protection of the subject of law.
