Aspectos Éticos en Investigaciones no Clínicas en el Campo de la Salud. Algunas Consideraciones acerca del Consentimiento Informado en Personas Declaradas Incapaces

RESUMEN

Este trabajo se enmarca en el proyecto de investigación UBACyT P040 cuya directora es Alicia Stolkiner. El consentimiento informado es un aspecto dentro de la investigación social cuya utilización se ha convertido en una condición ineludible para sostener la viabilidad de un estudio dentro de aspectos éticos aceptables. El objetivo de este trabajo es analizar la especificidad que adquiere el consentimiento informado en investigación cuando se trata de realizar estudios con sujetos que han atravesado un juicio de insania y como resultado del mismo han sido declarados incapaces.  Como metodología para este trabajo, se realizará un estudio documental de instrumentos normativos y legales (nacionales e internacionales) que regulan los aspectos éticos que deben ser considerados en investigaciones no clínicas en salud, y aquellos que legislan los derechos de las personas con problemáticas psiquiátricas en la Ciudad Autónoma de Buenos Aires y en la Provincia de Buenos Aires.

ABSTRACT

Ethical Aspects in non - Clinical Investigations in Health. Some Considerations about the Informed Consent in Incapable People

This paper is framed in the proyect of investigation UBACyT P040 whose director is Alicia Stolkiner. Informed consent is an aspect of social research that has become in recent years a prerequisite for sustaining the viability of a study within acceptable ethical aspects. The aim of this paper is to analyze the specificity of informed consent in research with people who has undergone a trial of insanity and as a result of it has been declared incapable. The methodology for this work is a documental study and the analysis of legal instruments (domestic and international) that legislate ethical aspects that must be considered in clinical research in health, and those that legislate the rights of people with psychiatric problems in Buenos Aires City and the Province of Buenos Aires.
